These are the conditions under which you can use Zenzey. They are written to be understood in one reading. If anything is unclear, write to info@dustkey.com before accepting them.
Who you are contracting with
It depends on where you are. If you are in Chile, the service is provided by Dustkey Chile SpA. From any other country, Dustkey LLC. The service is the same; what changes is who answers to you.
Who charges you is a different matter, and it is not always the same party: if you buy the subscription inside the app, Apple charges you; if you contract with an invoice, Dustkey Chile SpA charges you directly. The details are in Plans and payment.
- Dustkey Chile SpA — Chilean tax ID (RUT) 78.275.441-6. San Sebastián 2750, office 603, Edificio San Sebastián, Las Condes, Santiago, Chile. ignacio@dustkey.com.
- Dustkey LLC — a company organized in the State of Delaware, United States. info@dustkey.com.
By creating an account or using the app you accept these terms. If you use them on behalf of a band, a ministry, a school or a company, you represent that you can bind that organization.
What Zenzey does, and what it does not
Zenzey records a music session and generates a recap: the songs that were played, the decisions, the tasks and the ideas. The recap is written automatically by a language model from the transcript of the audio.
That means the recap may contain errors: misspelled names, a decision attributed to the wrong person, a song that was not detected. Zenzey is designed so that correcting takes one tap, and that correction is yours, not ours. Do not use a recap as a legal, accounting or evidentiary record without reviewing it.
Zenzey is not a music recording service: the audio is captured at voice quality, not demo quality, and the system does not judge how anyone sounded.
Recording other people
This is the most important obligation in this document, and it is yours.
When you press record, you are capturing the voices of people who probably do not have a Zenzey account and never accepted anything. By using the service you commit that:
- You take part in the session you record. Zenzey is not a tool for recording a conversation you are not in.
- You announce out loud, before starting, that the session is being recorded and that the audio will be processed as described in the privacy policy.
- You have the permission of the people who appear in the recording, and if someone asks you to delete a session, you delete it.
- If you record minors, you have the authorization of whoever is responsible for them.
In Chile, recording private conversations in a private venue without authorization is a crime. A rehearsal room is a private venue. This is not a formality: it is the reason Zenzey requires someone in the room to press the button and offers no way to record remotely.
Your account
- You need to be at least 13 years old to have an account.
- The details you provide must be real, and the credentials are yours: whatever happens from your account is considered done by you.
- You can delete it whenever you want from Profile → Delete my account. Your sessions, recaps, clips and photos go with it. It is immediate and cannot be undone.
Who owns what you record
You do. The audio, the recaps, the photos and the corrections you make remain the property of whoever they belong to: Zenzey claims no ownership over any of it.
You grant us only the permission needed to provide the service: to host your content, transcribe it, process it to generate the recap and show it to whoever you share the link with. That permission ends when you delete the content or the account.
Your audio does not train models. Neither ours nor our providers': the transcription is requested with the training opt-out enabled.
The links you share
A shared recap generates a public link with an address that cannot be guessed. Anyone who has it can open it without an account, so share it only with the people it is meant for. The link never gives access to the original audio or to the full verbatim quotes, and it stops working when the session is deleted.
What you cannot do
- Record people without their knowledge, or use Zenzey to surveil anyone.
- Try to identify whose voice is whose. Zenzey groups voices within a recording to organize the recap, but it builds no voiceprints and keeps none across sessions, and using the service for that is prohibited.
- Upload content you have no right to upload.
- Resell the service, share an account between groups that do not genuinely share it, or circumvent the limits of your plan.
- Extract data automatically, attack the infrastructure or try to access other people's sessions.
Plans and payment
Zenzey has a Free plan with a limited number of sessions and hours per month, and paid plans with more capacity. The current prices and limits of each plan are on the plans page.
There are two ways to contract a paid plan, and they do not work the same way.
From the app
The subscription is bought inside the app and Apple is who charges you, with the payment method on your App Store account. We never see or store your card number.
- It renews automatically at the end of each period until you cancel it.
- It is cancelled from the subscription settings of your Apple account, whenever you want and without explaining yourself to anyone. We cannot cancel it for you, but the plan stays active until the end of the period already paid and is not charged again.
- Refunds are handled by Apple, because Apple is who charged you. They are requested at reportaproblem.apple.com. If you believe you are owed one, write to us: we do not decide, but we will back you in writing before Apple.
- Apple charges in your local currency with the applicable taxes. In Chile, in pesos and with VAT included.
With an invoice, for organizations
A church, a school or a company can contract directly with Dustkey Chile SpA and receive an invoice. Write to ignacio@dustkey.com. In that case:
- The period and the payment method are whatever we agree in writing.
- We refund the first payment if you ask within the following 14 days, no questions asked. After that, periods already elapsed are not refunded, unless the law says otherwise — and the law prevails over this line.
In both cases, if prices change we notify you at least 30 days in advance and the change never applies to a period already paid.
If you downgrade or stop paying, your recaps are not deleted: you lose the features of the higher plan, not your history.
Availability and changes
Zenzey is a product under active development and it will change. We may add, modify or remove features. If we remove something your paid plan included, we notify you first and you can cancel. If you contracted with an invoice, we refund the unused proportional part. If you bought inside the app, Apple is who charged you and therefore who decides the refund: we back you in writing before them, which is what is in our hands.
We do not promise the service will be available without interruptions. We do commit to something concrete and verifiable: that a recording is never lost in silence. Every recording leaves a record, and if something fails, there is an explanation of what happened.
Suspension
We may suspend or close an account that breaches these terms, especially the section on recording other people. Unless the seriousness prevents it, we notify first and give a chance to correct. If we close your account without any breach on your part and you contracted with an invoice, we refund what was paid and unused; if you bought inside the app, we request the refund from Apple on your behalf.
Liability
The service is provided as is. To the extent permitted by law, the total liability of the party providing the service is limited to what you paid for Zenzey in the 12 months before the event giving rise to it.
None of this limits liability for willful misconduct or gross negligence, nor the consumer rights the law grants you and that cannot be waived.
If you downloaded Zenzey from the App Store
These terms are an agreement between you and the party providing the service, not with Apple. Apple has no obligation whatsoever to provide support or maintenance for Zenzey. If the app fails to conform to an applicable warranty, you may ask Apple for a refund of the purchase price, if any; beyond that, Apple is not responsible for the app or for any claims related to it, including intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
If you contracted with Dustkey Chile SpA, these terms are governed by the laws of the Republic of Chile and disputes are submitted to the ordinary courts of Santiago. If you contracted with Dustkey LLC, they are governed by the laws of the State of Delaware, United States.
In any case, if you are a consumer this does not deprive you of the non-waivable protection granted by the law of the place where you live.
Changes to these terms
If they change, the date above is updated. An important change — prices, your rights over the content or how audio is handled — is also announced by email or inside the app at least 30 days in advance. Continuing to use Zenzey after that is accepting it; if you do not agree, you can cancel and delete your account.
Language
This is an English translation of the Spanish original. If the two ever differ, the Spanish version prevails.
